The following document details our Privacy Policy and its application to a software platform that has a web front end and a mobile application downloadable from major app stores.

At THE WISE SEEKER S.L. (hereinafter The Wise Seeker) we attach great importance to your privacy and work in full compliance with the provisions of Regulation (EU) 2016/679 of 27 April (RGPD) and the Organic Law 3/2018 of 5 December, on Data Protection and Guarantee of Digital Rights (LOPDGDD).

1. Data Controller

The Wise Seeker, with registered office in Madrid, calle Collado Mediano, 6, bis, postal code 28034, with CIF number B-88209929 and e-mail address info@thewiseseeker.com, is responsible for the processing of the user’s personal data collected or generated as a result of the user’s access, use or navigation within the platform, both through any of its Web frontals and through its mobile application.

2. Purpose of Data Processing

The Wise Seeker is a platform whose ultimate purpose is to facilitate the meeting between professionals seeking employment and companies that demand it. To achieve this goal, the platform enables a series of evaluations and requests a set of additional data from its users, which make up objective information about their psychological profile and knowledge. These evaluations may or may not be associated with a specific selection process, as there are a series of additional services that base their added value on the analysis and processing of the data obtained by these mechanisms.

In accordance with the purposes mentioned in the previous section, at The Wise Seeker we process the following categories of data:

• Identifying data of the platform users: name, surname, postal address, e-mail address, zip code, telephone number, etc.
• Identification data of the companies that initiate a process within the platform: company name, address, VAT number, invoicing data, etc.
• Data on the psychological and knowledge profile of the platform users obtained from the evaluations carried out.
• Data on the training and work experience of the platform users that they have provided us with.
• Data on the use of the platform by its users as well as certain metadata derived from electronic communications exchanged with users.
• Commercial, economic, financial and banking information data, which are used in the corresponding activities of offer and provision of services by The Wise Seeker.

The data requested within the platform are mandatory, so that the refusal to provide them will make it impossible to carry out the provision of contracted services.

The user guarantees that the data provided are true, accurate, complete and updated, being responsible for any damage or loss, direct or indirect, that could be caused as a result of the breach of such obligation.

In the event that the user provides data of third parties, he/she declares to have the consent of the same and undertakes to transfer to the latter the information contained in this clause, exempting The Wise Seeker from any liability in this regard. However, The Wise Seeker may carry out checks to ascertain this fact, adopting due diligence measures as appropriate, in accordance with the General Data Protection Regulation 2016/679.

4. Conservation Period

We at The Wise Seeker store personal data for the time necessary to fulfill the purposes described above, unless you revoke the consents given in accordance with the provisions of Article 5.1-E of the General Data Protection Regulation 2016/679. If necessary, we will store the data for the corresponding legal purposes, deleting them at the expiration of the period of time for which they have been stored.

Once this period has elapsed, your personal data will be deleted as soon as all the necessary actions have been taken to manage and terminate any remaining obligations between the parties, carrying out all the necessary administrative steps during this period.

Similarly, if at any time you decide to delete your account, all data relating to your account will be deleted by The Wise Seeker and will not be recoverable or available to The Wise Seeker after deletion.

Notwithstanding the foregoing, your data will be kept duly blocked, as long as liabilities may arise, as well as for compliance with other legal obligations of The Wise Seeker. In this regard, The Wise Seeker guarantees that it will not process the data unless it is necessary for the formulation, exercise or defense of claims or when it is required to provide the same to the Public Administration, Judges and Courts during the period of limitation of their legal rights or obligations.

5. Security Measures

At The Wise Seeker we make every effort to ensure the security of your data within the framework of the General Data Protection Regulation 2016/679 and the Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights.

Your personal data, including your orders and customer login, will be encrypted for transmission using the SSL (Secure Socket Layer) encryption system, a system that is considered a security measure by the Spanish Data Protection Agency based on the provisions of Article 32 of the General Data Protection Regulation 2016/679. Online data transmission (e.g. by e-mail) may have security vulnerabilities, and complete protection of data against access by third parties is not possible.

To protect your data, we maintain technical and organizational security measures in accordance with the article mentioned in the previous paragraph, which we update regularly to reflect technological changes.

We cannot guarantee that our platform will be available at all times or at specific times. Disturbances of the servers used, outages or downtime cannot be excluded from the normal behavior of a software platform. The servers, which we use to support the platform, are properly backed up to provide maximum service availability to its users.

6. Data Communication

The Wise Seeker will provide user data to companies that create and manage processes within the platform, as this is its purpose. Likewise, the data provided by the companies within their processes will also be made available to users who participate in these processes in the search for a job. This cross-referencing of information is necessary for the platform to meet its objective.

In addition to the normal activity of the platform, in certain cases contemplated by current regulations, we may communicate our users’ data to:

• The Public Administrations with competence in the sectors of activity of The Wise Seeker, when so established by the regulations in force.
• The State Security Forces and Corps by virtue of the provisions of the Law.
• Banks and Financial Institutions for the collection of the services offered.

In general, The Wise Seeker may provide information about its users to other professionals, as long as such communication is required by law or for the execution of the contracted services.

7. Legitimation

The legitimacy for the processing of our users’ data comes from the consent given by the data subject in accordance with the provisions of Article 6.1-A of the General Data Protection Regulation 2016/679. On the other hand, the management of the contracting of services, payment, invoicing and corresponding shipments, is legitimized by the very execution of the contract established in Article 6.1-B of the General Data Protection Regulation 2016/679.

With regard to the registration of professional job offers that we may publish on our platform, the legitimacy is based on the user’s consent. This consent may be withdrawn at any time in accordance with the terms of
Article 7.3 of the General Data Protection Regulation 2016/679.
