General Information
THE WISE SEEKER S.L. (hereinafter The Wise Seeker) manages the access and use of a software platform for the identification and management of talent through the domain thewiseseeker.com and its corresponding subdomains.
The Wise Seeker has CIF B-88209929, and is domiciled at Calle Collado Mediano, 6, bis, 28034, Madrid and has its business address at Calle Orense 62 (local Utopicus), 28020, Madrid.

2. Acceptance of Terms and Conditions of Use
Express acceptance of the Terms and Conditions of Use is required in order to use the platform. Users who register on the platform are required to accept them along with the Privacy Policy.
The Wise Seeker may ban from the platform those users who do not comply with the Terms and Conditions of Use without prior notice.
The Wise Seeker reserves the right to notify platform users of any changes to the platform. Any change in the Terms and Conditions of Use and the Terms of Use
in the Privacy Policy must be compulsorily notified to the users so that they can expressly and unequivocally accept them.
All users of The Wise Seeker platform agree to:
- Guarantee the authenticity, veracity, timeliness and accuracy of all data communicated through The Wise Seeker, the user being solely responsible if otherwise.
- Use the platform exclusively for the purposes and functionalities provided for such purpose, such functionalities being presented as they are by The Wise Seeker, being forbidden for the user to use the platform for any other purpose or means.
- Make a legal and legitimate use of the platform, avoiding unauthorized, fraudulent, illegal or illegitimate use of the same and / or the content and information available through it, avoiding violating this legal notice and applicable regulations, and damage the rights and legitimate interests of The Wise Seeker or any other third party that may be affected as a result of such action.
- Not to cause damage to the systems or elements associated with the platform, its suppliers or third parties, or attempt to breach the security or authentication measures thereof, carry out any action that causes a disproportionate or unnecessary saturation in the infrastructure or communications environment related to the platform, in general, the Service, attacking it in any way. The Wise Seeker may take any preventive or corrective measures necessary to protect its interests in order to ensure the proper functioning of the platform, the service and the specific functionalities provided in each case.
- Not to introduce or disseminate through the platform computer viruses or malware that are likely to cause damage.
- Not to attempt to access, use and/or manipulate the data of The Wise Seeker, or under its responsibility, or of third party providers and other users.
- In particular, and by way of example and not exhaustive, not to transmit, disseminate or make available to third parties information, data, content, messages that may constitute an infringement of the rights of The Wise Seeker or third parties.
- Accessing without authorization or interacting with a false identity, impersonating or not the identity of third parties or using a profile or performing any other action that may generate confusion or mislead as to the correct identification of the user in question.
Any violation of the Terms and Conditions of Use will result in the possibility of The Wise Seeker expelling the user from its platform and the initiation of legal action against the user, without any indemnification effect.
3. Keywords
Companies that make use of The Wise Seeker platform in their talent evaluation or selection processes are called clients.
Individuals who register on the platform will be considered as candidates.
Both groups, clients and candidates, will be considered as users.
What is TheWise Seeker?
The Wise Seeker is a SaaS (Software as a Service) platform that serves to evaluate and map the talent of one part of its users, the candidates, for identification and management by the other group of users, i.e., the clients.
On the one hand, candidates can take multiple tests in two areas on The Wise Seeker platform:
- Knowledge tests, “hard skills”, which are grouped into different categories, disciplines or subjects: finance, marketing, technology, etc.
- Soft skills tests, comprising personality, skills, competencies, competency, aptitude and similar assessments.
Most tests are developed using true or false or single or multiple choice questions. Some of the tests, due to the specific nature of the subject matter, deploy particular questionnaires or different dynamics that facilitate interaction with those being evaluated.
On the other side are the clients or companies that, using different means provided by The Wise Seeker platform, access the information that candidates provide voluntarily or by accessing the aforementioned evaluations. The most frequent use of this group is the publication of job postings whose
The fundamental characteristics will be contrasted with the information collected from the candidates to determine their suitability or affinity for the position.
Candidates will be able to make evaluations being these associated to a job or not, being this second option a way to provide information to the platform of your profile so that it is responsible for providing information on related jobs that are published by customers or companies on the platform.
The tests will not be carried out continuously, but controls will be established within the platform to ensure the greatest veracity of the data collected from the
candidates.
The Wise Seeker’s analysis of the suitability of candidates for a job is completely objective and free of any bias based on gender, age, race, birth, religion or any other trait that could be discriminatory.
The Wise Seeker does not guarantee the veracity of the job offers of the clients or companies that make use of its services. The Wise Seeker also does not certify the candidates’ knowledge, but simply carries out an evaluation of certain disciplines or subjects, and puts the resulting information in the hands of the client, so that he/she can compare them.
The Wise Seeker does not provide any job intermediation services between clients and candidates. Therefore, in no case shall The Wise Seeker form part of the employment or service contracts that may be entered into between the parties.
5. Registration
In order to use the platform and take the different tests, it will be necessary to complete the registration process. The user undertakes to provide updated and truthful information about his situation so that any consequences arising from a user error will fall on the user and The Wise Seeker will be exempted.
In this process, the user must enter a password, being solely responsible for its reliability and for not disclosing it to any third party. The Wise Seeker recommends that passwords include uppercase, lowercase, numbers and symbols; and avoid using generic passwords that are easily cracked.
The Wise Seeker reserves the right to refuse registration and/or delete the account of those users who do not comply with the Terms and Conditions of Use of the platform.
6. Industrial and Intellectual Property
All industrial property rights and intellectual property rights of the software developed by The Wise Seeker, as well as all improvements and updates introduced, source code, design, navigation structure, databases, know-how, its derivative works as well as on the documentation associated with the software and all property rights, all applications, registrations, renewals, extensions and reinstatements thereof, current or future, in force and with full effect worldwide, are owned by The Wise Seeker.
All trade names, trademarks and distinctive signs of any kind contained in The Wise Seeker software platform are the property of The Wise Seeker.
The Wise Seeker reserves all rights to the software, including those not expressly granted to the user.
You acknowledge that The Wise Seeker owns all right, title and interest, including, but not limited to, all intellectual and/or industrial property rights in the software, or any information or material provided in conjunction with the software.
The user’s right to use the software shall be limited, so that the user may not:
- Sell, distribute, sublicense, publish, rent, lease, loan, assign, or otherwise transfer in any way the platform software or any information or material related thereto to any third party.
- Modify, adapt, translate, prepare derivative works, decompile, reverse engineer, disassemble or attempt to derive the source code of the software that supports this platform.
- Rent, lease or transfer its rights over the software that constitutes this platform.
- Use the software in any manner that could damage, disable, overburden, or impair the platform, nor may you use it in any manner that could interfere with any other party’s use and enjoyment of the platform.
- Remove, obscure or alter any copyright, trademark or other proprietary rights notices contained in the software on this platform.
7. Disclaimer of Warranties and Limitation of Liability
Computer programs or software may have errors and/or defects. Thus, the user is responsible for the risk as to the satisfactory quality of the software provided by the platform, its performance and accuracy, as well as in all matters arising from its use, and shall be solely responsible for any damage to his computer system or loss of data that may result from its use. The user disclaims any warranty regarding the security, reliability, speed and performance of the software related to The Wise Seeker platform, as well as its merchantability, fitness for a particular purpose, non-infringement of third party rights or its ability to
to be integrated into a given system.
The Wise Seeker is not responsible for any interruption in the operation of its software platform, computer failures, breakdowns, disconnections, delays or blockages that have been caused by the incompatibility of the platform with the user’s systems. The lack of compatibility, capacity, reliability or effective functioning of the user’s devices for the correct access to the platform is the user’s responsibility and he/she must be the one to check before contracting the service.

unauthorized intrusions by anyone other than The Wise Seeker. The Wise Seeker will take the necessary measures to protect its platform from unlawful intrusions.
8. Protection of personal data
The Wise Seeker guarantees that all personal data collected from its users, both clients and candidates, will be treated in accordance with the European Union Regulation 2016/679 of April 27 (General Data Protection Regulation or GDPR) and in accordance with the Organic Law 3/2018 of December 5 (LOPDGDD).

9. Others
If any provision of these Terms and Conditions of Use is declared, in whole or in part, invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions of Use which shall remain in full force and effect.
These Terms and Conditions of Use constitute the entire agreement between the parties and supersede any other prior agreements or understandings between the parties, oral or written, dealing with such subject matter, notwithstanding that the parties may agree to additional or particular conditions.
The Wise Seeker reserves the right to modify the presentation and configuration of its software platform. Users will always have the Terms and Conditions of Use available on the platform itself, which will be freely accessible for any queries they may wish to make.
The provisions of the clauses concerning Industrial and Intellectual Property, Exclusion of Warranties and Limitation of Liability and Protection of Personal Data shall remain in force after the end of the period of application of the Terms and Conditions of Use.
For the resolution of any conflict that may arise in relation to the interpretation or execution of these Terms and Conditions of Use, the parties, waiving any other jurisdiction that may correspond to them, shall submit to the Courts and Tribunals of the city of Madrid. These Terms and Conditions of Use shall be governed by and construed in accordance with Spanish law.
In the event of any discrepancy between the Spanish version and the version in any other language, the Spanish version shall prevail.
